This is a translation for your convenience: if it differs from the Russian version of this page, the Russian version prevails.
1. General provisions
- This document is the official proposal (public offer) of the online service STEAMGIFTS (the “Seller”), located at steamgifts.ru (the “Site”), and contains all the essential terms for providing services for the sale of digital goods.
- Under Article 437 of the Civil Code of the Russian Federation, this document is a public offer. This offer is accepted when the Buyer places an order on the Site and pays for the selected goods or services.
-
The following terms and definitions are used in this agreement:
- Seller — the online service STEAMGIFTS, which sells digital goods through the Site.
- Buyer — a legally capable individual aged 18 or over, or a legal entity, placing an order on the Site.
- Site — the internet resource located at steamgifts.ru.
- Product — digital goods available on the Steam platform (computer games, downloadable content (DLC), software and other content), transferred to the Buyer through the Steam gift feature, as well as Steam wallet top-up services.
- Order — a request placed by the Buyer to purchase a Product through the Site.
- The Seller reserves the right to amend this agreement. Amendments take effect from the moment they are published on the Site.
2. Subject of the agreement
- The Seller undertakes to transfer digital goods to the Buyer (digital goods of the Steam platform and/or Steam wallet top-up services) in accordance with the terms of this agreement, and the Buyer undertakes to pay for and accept these goods.
- The range, names, prices and descriptions of goods are set out on the relevant pages of the Site and may be changed by the Seller unilaterally.
- The appearance, characteristics and properties of goods may differ from those shown on the Site because of the nature of digital products and changes made by the rights holders.
3. Placing an order
- The Buyer places an order on the Site independently by adding the selected goods to the cart and then confirming the order.
-
When placing an order, the Buyer must provide the following information:
- a link to their Steam profile (when buying digital goods);
- the Steam account region;
- other data requested by the order form.
- The Buyer is responsible for the accuracy of the data provided. The Seller is not liable if an order cannot be fulfilled because the Buyer provided incorrect information.
- The agreement is deemed concluded from the moment the Buyer pays for the order.
4. Prices and payment
- Prices for goods are shown on the Site in Russian rubles (₽) and may be changed by the Seller unilaterally. The price in effect when the order is placed cannot be changed after the order is paid for.
- Payment is made by one of the methods offered on the Site: by bank card, through the Faster Payments System (SBP), by e-money or by other available methods.
- The Buyer may top up their internal balance on the Site (the “Balance”). Balance funds are a prepayment and may be used only to pay for goods and services on the Site. Topping up the Balance is not a purchase of goods and is non-refundable, except in cases provided for by the applicable law of the Russian Federation.
- The Buyer may use Balance funds to pay for an order in full or in part.
- The moment of payment is the moment the funds reach the Seller's settlement account or the payment system confirms the payment.
- The Seller may set a fee for certain payment methods. Information about the fee is shown to the Buyer before the order is paid for.
- If an order cannot be fulfilled for reasons related to a change in the rights holder's pricing or regional policy, the Seller may cancel the order and refund in full the money paid by the Buyer.
5. Delivery of goods
- Digital goods are delivered by sending the license as a gift to the Buyer's Steam account specified when placing the order.
- Steam wallet top-ups are carried out by crediting funds to the Steam account specified by the Buyer when placing the order.
- The delivery time depends on the type of product and is usually from a few minutes to 72 hours from the moment payment is confirmed. The Seller makes every effort to deliver as quickly as possible.
- The Seller's delivery obligations are deemed fulfilled from the moment the Buyer accepts the gift on Steam or the funds are credited to the Steam account.
6. Refund conditions
- Refunds are made in accordance with the rules set out on the Refund conditions page.
- The Buyer must read the refund conditions before placing an order.
- A digital product is not refundable after the Buyer has accepted it (by accepting the gift on Steam), except in cases provided for by the applicable law of the Russian Federation.
7. Liability of the parties
- The Seller guarantees that the licenses transferred are valid at the moment the gift is sent to the Buyer, provided that the Buyer complies with regional restrictions.
- The Seller is not liable if the product cannot be received for reasons beyond the Seller's control, including: blocking or restriction of the Buyer's Steam account, violation of the Steam platform rules by the Buyer, the Buyer's refusal to accept the gift, or a change in regional restrictions by the rights holder.
- The parties are released from liability for failure to perform, or improper performance of, their obligations under this agreement in the event of force majeure.
- The Seller's total liability under this agreement is limited to the amount paid by the Buyer for the relevant order.
8. Processing of personal data
- By placing an order on the Site, the Buyer consents to the processing of personal data in accordance with the Privacy Policy and the Consent to personal data processing.
- The Seller undertakes to use the Buyer's personal data solely for the purpose of fulfilling its obligations under this agreement.
- The Seller protects the Buyer's personal data in accordance with the requirements of Federal Law No. 152-FZ of 27 July 2006 “On Personal Data”.
9. Dispute resolution
- All disputes and disagreements between the parties arising from the performance of this agreement are settled through negotiation. The Buyer can contact the Seller by email: support@steamgifts.ru.
- If a dispute cannot be settled through negotiation, it is subject to consideration in accordance with the applicable law of the Russian Federation.
- A pre-trial claim procedure is mandatory. A claim is considered within 10 (ten) working days of receipt.
10. Final provisions
- This agreement takes effect from the moment the Buyer accepts it and remains in force until the parties have fully performed their obligations.
- The Seller may unilaterally change the terms of this agreement. Changes are published on the Site and take effect from the moment of publication. Continued use of the Site after the changes are made means that the Buyer agrees to the new terms.
- In everything not provided for by this agreement, the parties are guided by the applicable law of the Russian Federation.
